PHOENIX, ARIZONA — A new safeguard has been established to protect Arizona homeowners and their properties after SB 1110 (recorded documents; property; notification) was signed into law.
This bill, which had broad bi-partisan support, allows individuals to opt into a system that requires county recorders to send a notification if the individual is a named party in a recorded instrument. This includes any action taken against a person's title. The notice will be sent promptly via email, text message, or other similar means.
"The state has documented a disturbing trend over the last few years where people are having their homes sold out fro1n unde1neath them," said Senator Rogers. "Homeowners can pay organizations to notify them before this type of deed fraud can occur, but the better solution is to have a county system in place. This new law significantly increases consumer protection, especially for the elderly who saved their whole lives and rightfully own their own homes free and clear. This is a win-win for everyone. Other states already do this, and I believe we should follow what other states are doing when it works."
This legislation will take effect beginning January 1, 2025.
